These Terms of Service ("Terms") govern your access to and use of Our Services. Please read them carefully before using the Service.

Interpretation

Words with capitalized initial letters have defined meanings under the conditions below. These definitions apply equally whether used in singular or plural form.

Definitions

For the purpose of these Terms:

• "Account" refers to a unique Account created by You to access our Service.
• "Company" (also referred to as "We", "Us" or "Our") means PowerupStack.
• "Website" refers to PowerupStack, accessible from https://powerupstack.com.
• "Service" refers to the Website and all associated services provided by the Company.
• "Server" refers to the game server offered as part of the Service
• "Client" means an individual or entity currently using or having used the Service within the past two years.

Availability of Services

1. We strive to make the Service available 24/7. However, interruptions may occur due to scheduled maintenance or unforeseen events beyond our control.
2. We make reasonable efforts to minimize downtime and restore availability promptly, but we do not guarantee uninterrupted access.

Instance Queues and Capacity

Instance starts may be queued depending on demand and available capacity. We do not guarantee immediate availability.

Paid customers receive priority access to capacity and will typically experience little or no queueing. It is in our interest to maintain a reliable service for paying customers, and we aim to scale capacity as paid demand grows. Temporary capacity constraints may still occur while additional capacity is being added.

Free tier capacity is not guaranteed and may depend on capacity not currently needed by paying customers. As paid demand increases, less capacity may be available to Free tier users, which can result in longer queues. Free tier capacity may also vary by region based on demand, cost, and available infrastructure.

Account

1. Most Website features require an Account. To register, You must provide an email address, and password.
2. If You lose access to your password, recovery is only possible via the linked email address.
3. You are responsible for maintaining the confidentiality of your credentials. All activity under your Account is your responsibility, to the extent permitted by law.
4. We are not liable for loss of access due to forgotten credentials or failed two-factor authentication. Recovery is not guaranteed.
5. We reserve the right to deny access to the Website or Services at our discretion.
6. You may close your Account at any time via account settings. Closure takes effect after 7 days unless canceled by logging in and aborting the process. After this period, operational Account data is deleted or anonymized. Limited billing, consent, security, support, and legal records remain only for the periods described in the Privacy Policy.

Age requirement

To use our Services, You must be at least 13 years old. By accessing or using the platform, You confirm that:

• You are 13 years of age or older.
• If you are under the age of majority in your jurisdiction (typically 18), you have obtained permission from a parent or legal guardian to use the service.
• We do not knowingly collect personal data from individuals under 13. If we discover such use, we will remove the Account and associated data.

If You do not meet these age requirements, You may not use the Service.

Support

1. For questions about your Account or the Service, You may contact customer support by submitting a support ticket. Response times may vary.
2. We do not provide support for third-party plugins or mods. Please consult the relevant provider or our knowledge base for guidance.

Third-party content

1. The Website allows installation of third-party content (e.g., mods, plugins). This content is provided "as is" without guarantees of functionality, safety, or continued updates.
2. You are responsible for any third-party content You install. Such content may cause configuration issues or data loss. You are expected to resolve these issues independently.

Game Integrations

To improve the user experience, we may provide deep integrations with certain games that make server configuration and management easier and more intuitive. These integrations may depend on game-specific formats, APIs, files, or behavior and may therefore stop working or behave incorrectly when a game is updated.

Our development efforts are generally focused on supporting the latest stable versions of supported games. We do not guarantee that integrations will work with older game versions, nor do we guarantee that integrations will be compatible immediately following the release of a new game version.

If you experience an issue with an integration, you may contact our support team and we will investigate where reasonably possible. Support for older game versions may be limited, and in some cases it may not be technically or commercially feasible to restore compatibility.

Updates, repairs, or compatibility changes to integrations may require significant development time, including days or weeks. We do not guarantee that an integration will be fixed, updated, or restored within any particular timeframe, or that compatibility with a specific game version will be provided.

All game integrations are provided on a best-effort basis and should be considered convenience features rather than guaranteed functionality of the Service.

Customers retain access to their server files. Many actions provided through these integrations, such as modifying configuration or game data, may therefore still be performed manually through file access when an integration is unavailable or incompatible.

Abuse and limitations

1. You agree to use the Services only for their intended purpose and in compliance with applicable laws.
2. Abuse of Services or circumvention of technical restrictions is prohibited.
3. Excessive use of resources (CPU, memory, disk, bandwidth) is not permitted.
4. We reserve the right to suspend or terminate your Account and associated Services. Access to suspended or terminated Accounts is not possible.

Free Servers

The following terms apply specifically to free Servers:

1. Creating or operating multiple Accounts to bypass free Server limits is prohibited.
2. Free Servers are offered at no charge. Reselling is not allowed. You may monetize via donations or content creation, provided EULAs are respected.
3. Uploading or downloading executable files or scripts is prohibited. Only approved workshop content may be installed.
4. We automatically stop Servers without active players. Attempts to fake or prolong activity are prohibited.
5. Automating Server start/restart actions is not allowed.
6. Inactive servers are scheduled for deletion after a defined inactivity period. An email alert is sent to the server owner beforehand.

Server data and backups

1. Server data is stored redundantly to tolerate disk failures. However, this is not a guarantee against data loss. Backup and restore options are available, and additional backups may incur charges.
2. When a Server is deleted, all associated data and backups are permanently removed. It is your responsibility to download any data you wish to retain.

Service level agreement

1. No availability guarantees are provided for free Services.

Refund Policy

Purchases of digital credits are subject to our Refund Policy, which forms part of these Terms of Service.

By ordering credits, you acknowledge and agree to the conditions outlined in the Refund Policy, including:

• A 24-hour money-back guarantee if you are not satisfied with the Service or it is not what you expected.
• Your waiver of the statutory 14-day withdrawal right once credits are used or allocated.
• After the guarantee period, eligibility for refunds on unused or minimally used credits (under 5%) at our discretion.
• Non-refundable situations outside the guarantee, such as promotional credits, partial usage, or account termination due to breach.

Credit usage

Credits issued or purchased within the Service are intended solely for use toward eligible features and services. They do not hold any monetary value and, except as provided by our Refund Policy or applicable law, are not refundable, transferable, or redeemable for cash or other compensation.

• No Cash Value: Credits cannot be exchanged for currency or used outside the platform.
• Non-Transferable: Credits may not be sold, gifted, or transferred between accounts.
• Expiration and Forfeiture: Unused credits may expire after 2 years of account inactivity, or be forfeited in accordance with platform policies.

By using the Service, You acknowledge and agree that credits are a digital utility and not a financial instrument.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall We be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) however caused and on any legal or equitable theory of liability, and whether or not for breach of contract, negligence or otherwise, even if the Company has been advised of the possibility of such damages. In any case, the Company's entire liability under any provision of this agreement shall be limited to the amount received by the Company from the Client, if any, for use of the Services.

Governing law

These Terms are governed by Dutch law. Any disputes will be resolved exclusively by the Dutch courts.

Amendments

We may update these Terms at any time. You may be notified via email or in-platform notice. Significant changes may require your review and acceptance.

If You do not agree to the updated Terms, the last version You accepted remains in effect, but You must stop using the Service within 30 days.

The current version of the Terms is always available on this page.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, deemed severed from the Terms. The remaining provisions shall remain in full force and effect.
